Terms of Service

APPRZR is an AI item valuation and appraisal service operated by Jason Fitzpatrick, trading as APPRZR ("APPRZR", "we", "us"), accessible at apprzr.com. When you create an account or purchase credits, you are contracting with us. Questions? Contact hello@apprzr.com.

By creating an account, purchasing credits or otherwise using APPRZR, you agree to these Terms. If you do not agree, do not use the service. You confirm you are of legal age to form a binding contract, or, if you use APPRZR on behalf of an organisation, that you have authority to bind that organisation.

APPRZR lets you upload photographs of an item and receive an AI-generated valuation report: an item identification, condition grade, estimated value range, market insights and resale listing copy. Access is provided through credits: each appraisal consumes one credit, purchased in packs or granted on registration. Guest previews are provided as-is for evaluation purposes.

We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You may not reverse engineer the service, resell or redistribute access, reports or credits, or circumvent technical limits.

You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Provide accurate information and keep it current. Tell us promptly at hello@apprzr.com if you suspect unauthorised use of your account.

You must not misuse the service. In particular, you must not:

• use it for any unlawful purpose, including infringing others' intellectual property rights;
• commit fraud, send spam, or circumvent credit limits, usage caps or technical restrictions;
• interfere with the service's security — including introducing malware, probing or scanning vulnerabilities, scraping, or attempting to access other users' data;
• reverse engineer the service except where such restriction is prohibited by law;
• resell or redistribute access, reports or credits without our written consent.

When using the AI features, you must additionally not:

• submit illegal content, or use the service to create deepfakes, hateful or harassing material, sexual content involving minors, or malware;
• attempt to jailbreak, bypass or manipulate the AI models' safeguards;
• submit photographs of items you do not have the right to photograph and appraise.

All valuations, condition grades, market insights and listing copy produced by APPRZR are AI-generated estimations for informational purposes only. They do not constitute certified insurance, financial, legal or auction-house appraisals, and must not be relied upon as such. AI outputs may be inaccurate or incomplete; you are responsible for verifying any valuation before relying on it, and for obtaining a qualified professional appraisal where a certified valuation is required (for example for insurance, probate or sale).

You retain ownership of the photographs you upload ("your content"). You grant us a limited licence to host, transmit and process your content, and to send it to our AI providers, solely to provide the service. You are responsible for your prompts, category selections and the photographs you submit, and confirm you have the necessary rights to them.

Valuation reports generated for you are for your use. If you believe any content or output infringes your rights, contact hello@apprzr.com with details of the work and the allegedly infringing material; we will investigate and remove infringing content. Repeated infringement may lead to suspension or termination of your account.

APPRZR, including its software, design, branding and documentation, is owned by us or our licensors. Nothing in these Terms transfers ownership to you.

Credits are consumed each time you run an appraisal. Credit packs are one-time purchases; prices are shown at checkout and may include applicable taxes as calculated at purchase. Credits are personal to your account, hold no monetary cash value, and expire only if your account is closed.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all APPRZR orders. Paddle handles billing, customer service, and transaction inquiries, including tax collection and refunds. Payment, billing and refund mechanics are governed by Paddle's Checkout Buyer Terms.

We aim to keep APPRZR available and accurate, but we do not guarantee uninterrupted or error-free performance. We may add, change or remove features, and may suspend the service for maintenance.

We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or seriously or repeatedly violate our policies. Where feasible we will tell you why and give you a chance to remedy a fixable breach.

You may stop using the service and close your account at any time by emailing hello@apprzr.com. On termination, your access ends and your Vault contents and personal data are deleted within 90 days, unless we must keep them for legal reasons. Please export anything you want to keep before closing your account.

Except as stated in these Terms, the service is provided "as is" and "as available", and all implied warranties — including merchantability and fitness for a particular purpose — are disclaimed to the fullest extent permitted by law.

To the fullest extent permitted by law, neither party is liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability to you is capped at the fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.

You agree to indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these Terms.

These Terms are governed by the laws of Ontario, Canada, and the courts of Ontario have exclusive jurisdiction over any dispute. We may assign these Terms in connection with a merger or acquisition; you may not assign them without our consent. If a provision is unenforceable, the rest remains in force. We may update these Terms; material changes will be announced on the service, and continued use after that constitutes acceptance. Force majeure excuses performance during events beyond our reasonable control.
